On March 14, 2019, the United States District Court, Central District of California, Southern Division (the “Court”) entered a Temporary Restraining Order and Orders: (1) Freezing Assets; (2) Prohibiting the Destruction of Documents; (3) Granting Expedited Discovery; (4) Requiring Defendants to Surrender Passports; and (5) Requiring Accountings; and Order to Show Cause Why a Preliminary Injunction Should not be Granted.
On March 14, 2019, the Court also entered the Order Appointing Receiver which appointed Robert P. Mosier as the Receiver for the estates of the Church for the Healthy Self, CHS Asset Management, Inc., Kent R.E. Whitney, and David Lee Parrish.
On March 14, 2019, the Court also entered the Order Appointing Receiver which appointed Robert P. Mosier as the Receiver for the estates of Church for the Healthy Self a/k/a CHS ZTrust, CHS Asset Management, Inc., iCare Financial Solution, Inc., Kent R.E. Whitney, David Lee Parrish, and Ngoc Ha T. Nguyen (the "Receivership Defendants").
On September 11, 2019, the Securities & Exchange Commission filed an amended complaint that, among other things, added iCare Financial Solution, Inc., and Ha Nguyen as defendants. By order entered on September 12, 2019, the Court formally expanded the scope of the receivership estate to include iCare Financial Solution, Inc. and the assets of Ha Nguyen. Robert P. Mosier continues to serve as the Receiver.
The Court has approved the claim procedure that the Receiver proposed. In late April 2020, the Receiver mailed claim packages with a claim form to all investors at their last known address. If you did not receive one, please email firstname.lastname@example.org and she will send one to you. The deadline to return the claim forms to the Receiver’s office is July 31, 2020. The claim forms should not be filed with the Court. If you do not timely return a signed claim form to the Receiver, you will not receive a distribution from the receivership estate. After the Receiver reviews the claims and resolves any discrepancies, he intends to seek Court approval to make an interim distribution to investors. This website will be updated with a more specific timeline once that can be determined.
