  1. Why did Macaroni Grill file for protection under Chapter 11 of the U.S. Bankruptcy Code?

    Macaroni Grill took this step only after very careful consideration and consultation with experienced financial and legal experts. Macaroni Grill decided that this would be the most effective path for it to shed legacy liabilities and obligations, as a result of decisions by past ownership. This step protects and helps maximize the value of Macaroni Grill’s assets for the benefit of its employees, creditors and other stakeholders.

  2. Does this mean that Macaroni Grill is going out of business?

    Absolutely not. Macaroni Grill filed for protection under Chapter 11 to shed legacy liabilities that were negatively impacting and hindering the Company’s path forward. Macaroni Grill will operate in a “business as usual” mode during the Chapter 11 process. The Court has authorized Macaroni Grill to continue all customer programs, without any interruption, and continue all regular compensation and benefits currently provided to employees. Additionally, Macaroni Grill has obtained the support of its existing secured lenders and additional funding to finance its operations during and after the bankruptcy. Macaroni Grill remains a strong and notable brand in the casual dining space with 93 stores nationally in 25 states.

  4. How long will the chapter 11 process take?

    Macaroni Grill has the support of its secured lenders, its ownership group and has a plan that clearly shows the Company’s path to profitability. Additionally, the Company has secured new, third-party financing to fund the execution of the go-forward business plan. All parties are focused on moving promptly toward the confirmation of the plan for Macaroni Grill. However, there is no way to predict with certainty how long the process will ultimately take.   5. Am I a creditor in these Chapter 11 Cases?

    If you are owed money by Macaroni Grill from a claim arising before October 18, 2017, then you may be a creditor for the purposes of these Chapter 11 cases.   6. Do I need to file a proof of claim?

    If you are a creditor, you should timely file a proof of claim form to receive a distribution under Macaroni Grill’s chapter 11 plan on account of your prepetition claim. While Macaroni Grill will request that the Bankruptcy Court establish a claims bar date (i.e., a deadline by which parties must file a proof of claim), a claims bar date has not yet been established. Once a claims bar date is established, all known creditors will receive notice of the claims bar date and this page will be updated.

  7. What is the purpose of the chapter 11 plan?

    The chapter 11 plan is a document which describes how a debtor corporation will emerge from a Chapter 11 bankruptcy and treat its creditors. It will detail which parties will be receiving distributions from the debtor’s bankruptcy estates on account of their claims. The chapter 11 plan must be approved by votes of the requisite numbers and amounts of eligible creditors and interest holders and it must be confirmed by the Bankruptcy Court.
