Class Members

The Class includes all Persons who owned a LifeTrend 3 Policy or LifeTrend 4 Policy that was surrendered or lapsed on or after October 1, 2008 and before June 30, 2013. However, the Class does not include LifeTrend 3 Policies or LifeTrend 4 Policies included in the class action settlement in a separate lawsuit known as Brady v. Conseco Life Insurance Company, Inc., et al., No. 3:08-CV-5746 (N.D. Cal).

The Class does not include: (1) Persons who timely opt out of the Class; (2) governmental entities; (3) the judges to whom this case is assigned and their immediate family members; (4) the lawyers on the case and their immediate family members; and (5) Conseco Life, Wilton Re, the Wilco Life Affiliates, the Wilco Life Agents, the CNO Defendants, the CNO Affiliates, and the CNO Agents.

Your Rights and Options as a Class Member

Complete and return W-9 form mailed to you

- You will receive a payment from the Settlement once it is approved by the Court.

- You will give up rights to bring any other lawsuit against Conseco Life about the claims in this case and released in the Settlement.

- This is the only way to receive payment under the Settlement.

Ask to opt out of the Class

- You will not receive a payment from the Settlement.

- This is the only option that may allow you to retain your right to bring a lawsuit against Conseco Life about the claims in this case and released in the Settlement.

Object to the Settlement

- You can write to the Court if you want to object to the terms of the Settlement.

- You can both object and return a W-9 form to receive any payments approved by the Court after considering your objection.

Go to a hearing in Indianapolis

- You can request to speak in Court in Indianapolis about the fairness of the Settlement.

- You can both go to a hearing and submit your W-9 form to receive any payments approved by the Court after hearing your comments.

Do nothing

- You will forgo a payment under the Settlement.

- Even though you will not receive a payment, you will give up rights to bring any other lawsuit against Conseco Life about the claims in this case and released in the Settlement.
